How will changes to immigration law affect your business?

As reported to APSCo Members yesterday, Immigration Minister Alex Hawke has recently announced changes that could mark better news for the recruitment industry. The change provides a pathway for employer sponsored temporary resident visa holders on the ‘short-term’ occupation list to apply for permanent residence (PR) after the 1st of July 2022, providing an opportunity for a large cohort of Recruitment Consultants to gain PR.

Essentially, this opens eligibility for the Subclass 186 employer sponsored visa under the TRT stream to individuals whose occupation is on the short-term occupation list, provided they:

  • Have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021; and
  • At the time of application, are employed by an actively and lawfully operating business in Australia.

How should agencies be managing this change?

Maroun Elias, Senior Immigration Manager at Ernst & Young, and Emerge 2022 panellist, says agencies should be reviewing their sponsored visa holders currently working as Recruitment Consultants to assess the eligibility of these visa holders to apply for PR.
